The Oversight Board, known to several Instagram users as the app’s Supreme Court has noted that their policies related to sensitive topics are potentially posing “greater barriers to expression for women, trans and gender non-binary people on its platforms.”

Thus, they are reconsidering their policies and they have decided to enable trans and non-binary people to show their breasts if they are willing. However, this amendment doesn’t apply to cisgender women.

The policy update is specific for the Transgender community and for people who don’t identify themselves as female or male. The policy remains the same for cisgender women, who usually identify themselves with the gender and can give birth.

According to a recent statement from the Oversight Board, “The same image of female-presenting nipples would be prohibited if posted by a cisgender woman, but permitted if posted by an individual self-identifying as non-binary.”

Meta keeps making changes as per their user’s requirements thus it has welcomed the latest decision proposed by the app’s Supreme Court.

In response to this new development from Instagram a spokesperson from the app has revealed that “We welcome the board’s decision in this case.” He added that the company plans to respond to the board’s broader recommendations, which he said are non-binding, in 60 days.”

He further added, “We had reinstated this content prior to the decision, recognizing that it should not have been taken down”. “We know more can be done to support the LGBTQ+ community, and that means working with experts and LGBTQ+ advocacy organizations on a range of issues and product improvements”, she continued.

The amendment has been made following two incidents that took place in 2021 and 2022. As per the details, a US-based binary couple posted two different pictures on an Instagram handle where they were featured showing their breasts with only the nipples covered.

In the caption, the couple talked about transgender healthcare before revealing the information about undergoing chest surgery for a flatter chest.

After several reviews and an automated moderation for violating the community guidelines, both posts were removed from the platform. However, when the couple reported to the board, the pictures were later restored.

Following this incident, the content regulatory board of Instagram decided to review the policy and they have decided to lift the ban from the Free the nipples policy of Instagram.
